Child Support

New Jersey Child Support Lawyers

Child support is often a very contentious issue for parents. Some parents believe they are paying too much, while the other side believes they are receiving too little support. Our lawyers at the office of Iandoli, Edens & Weinberger, LLC can help you understand how child support is awarded and the process through which it is calculated. We serve clients throughout New Jersey.

Since the amount of child support awarded is governed by Court Rules, a formula is used to calculate the amount to be paid. The numbers that are inserted into the formula to gain the result must be precise in order for the amount of child support to be accurate.

In cases of substantial household income, the amount of child support awarded may deviate from the guidelines. Child support may continue through college and may include private school and college tuition / graduate school tuition and expenses. It is important to have a knowledgeable attorney to help you sort through the various factors related to child support.

Modification and enforcement of child support orders

Modification of child support, or an action to enforce it, can take place any time after a temporary court order, marital settlement agreement, or the divorce judgment is executed.

  • Enforcement is the effort to make sure that child support and arrearage payments are made. Courts are generally willing to take strong measures to enforce child support payments, including invading asset accounts, or issuing bench warrants for arrest and incarceration for failure to pay.
  • Modification is the process used to change the amount of child support payments. If the circumstances of either party has substantially changed since the initial child support order (a significant increase or decrease in income), we can petition the court for a modification of the child support order.
